The Massachusetts Supreme Judicial Court on Friday ruled in favor of Mr. Ibanez, who had his home foreclosed upon by U.S. Bank in 2007. Mr. Ibanez's Mortgage had been resold 5 different times and eventually end up in a pool of mortgages where U.S. Bank was the trustee. Because the mortgage was not assigned directly to U.S. Bank, the court ruled that U.S. Bank had no right to do a foreclosure, because they were not the" Mortgage Holder of Record." Mr. Ibanez gets his home back! This ruling may have serious impact on many if not all of the foreclosures that have been done in Massachusetts over the last however many years. Will Title Insurance companies write Title Insurance, for someone buying a foreclosure, if the foreclosing entity was not the "Mortgage Holder of Record" at the time the foreclosure was done? This decision will have impact across the country and it will be interesting to see how it plays out over the next few months. Here is a link to one of the articles.

The process of obtaining a Massachusetts Real Estate License is as simple as following a few directions and completing the required class time as mandated by the state. To begin the real estate license process you must first enroll in an approved Massachusetts Real Estate Academy and take a Pre license Course before you schedule an exam. The state of Massachusetts and the Division of Professional Licensure require that new real estate agents complete 24 hours of classroom training in order to be eligible to take the Massachusetts real estate license exam. The Mass real estate class educates prospective licensees in consumer protection laws, real estate contracts, deeds, appraising, financing, equal housing lender laws and many more topics that will be essential for practicing Massachusetts Real Estate Agents. Bill Morgan Real Estate Academy offers a Pre-license class in two formats:
- 12 hour a day – 2 day course
- 8 hour a day – 3 day course
Click here to see the Massachusetts Real Estate Pre-License Class Schedule.
Once you have completed the required course work, you must pass the Massachusetts Real Estate Exam which is administered by the Massachusetts Board of Registration of Real Estate Brokers & Salespersons. Visit their website or obtain a handbook in order to determine the best time for you to take the exam. Exams are not available on all days in all areas, but there are many locations in the greater Boston area that can accommodate a busy professional. Upon passing the two part exam (the general real estate section and the Massachusetts specific section) you must fill out the real estate application and pay the appropriate fees. You can obtain an application from the Mass Board of Registration of Real estate Brokers and Salespersons. Once you have become a real estate agent you must take continuing education credits to renew your Massachusetts Real Estate License. You must complete 12 hours of class time every two years in order to stay current. The Massachusetts board will send you a renewal application where you must check off that you have completed the course work and send in the application with the renewal fee.
